1. Acceptance of Terms

By accessing and using Skillspad ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

Skillspad is a digital marketplace that connects creators, affiliates, and buyers. The Platform enables creators to sell digital products, courses, templates, and services; affiliates to promote products and earn commissions; and buyers to discover and purchase digital products.

3. User Accounts

3.1 Registration

You must create an account to use certain features of the Platform. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3.3 Account Types

Users may register as:

• Creators: Sell digital products and services
• Affiliates: Promote products and earn commissions
• Buyers: Purchase digital products

4. Creator Terms

4.1 Content Ownership

Creators retain ownership of their content. By uploading content to Skillspad, you grant us a non-exclusive license to host, display, and distribute your content through the Platform.

4.2 Content Standards

Creators must ensure their content:

• Does not infringe on intellectual property rights
• Is accurately described and represented
• Does not contain illegal, harmful, or offensive material
• Meets quality standards expected by buyers

4.3 Pricing and Payments

Creators set their own prices. Skillspad charges a platform fee on each transaction. Payouts are processed according to our payment schedule and terms.

5. Affiliate Terms

Affiliates may promote products listed on Skillspad and earn commissions on successful referrals. Commission rates are set by creators. Affiliates must comply with applicable advertising laws and disclose their affiliate relationship when promoting products.

6. Buyer Terms

6.1 Purchases

All purchases are subject to acceptance by the creator. Prices are in Ghana Cedis (GHS) unless otherwise stated. You agree to pay all charges incurred by you or on your behalf through the Platform.

6.2 Access to Products

Upon successful payment, you will receive access to the purchased digital product. Access is granted for personal use only and may not be shared, resold, or redistributed.

7. Payment Processing

Payments are processed through Paystack and other third-party payment providers. By making a purchase, you agree to the payment provider's terms of service. Skillspad is not responsible for payment processing errors or delays caused by third-party providers.

8. Prohibited Activities

You may not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Engage in fraudulent activities
• Harass, abuse, or harm other users
• Attempt to circumvent security measures
• Use automated systems to access the Platform

9. Intellectual Property

The Skillspad Platform, including its design, features, and functionality, is owned by Skillspad and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the Platform.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SKILLspad DOES NOT GUARANTEE THE ACCURACY, QUALITY, OR AVAILABILITY OF PRODUCTS LISTED BY CREATORS. WE ARE NOT RESPONSIBLE FOR DISPUTES BETWEEN CREATORS AND BUYERS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKILLspad SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason. Upon termination, your right to use the Platform will immediately cease.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice on the Platform or sending you an email. Your continued use of the Platform after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Ghana. Any disputes shall be resolved in the courts of Ghana.
